BATAVIA — There will be a sidewalk along Lewiston Road from Park Road to Veterans Memorial Drive at some point, although we don’t know exactly when.
The Town Board Wednesday night approved an agreement with 570 DAB 30, LLC (Benderson Development, Inc.), the owner of property at 8363 Lewiston Rd., the site of the vacant Kmart, which plans to have two buildings built in the parking lot to house businesses, with each building including a drive-thru. One building will be 6,752 square feet and the other 4,000 square feet.
“The town currently does not have a sidewalk district and is requiring a committing from the owner for future sidewalk installation,” the resolution passed at the board’s regular meeting read.
After the meeting, Deputy Supervisor Dan Underhill said the town has to come up with a sidewalk district as part of the agreement. Benderson agreed to pay for the sidewalk as part of getting the permits for the building project, Underhill said.
Jerry Arena, owner of Jerry Arena’s Pizzeria at 8360 Lewiston Rd., spoke about his concerns about the Kmart parking lot and the areas near it that don’t have sidewalks. Arena has spoken about his concern over the lack of a sidewalk in that area at past meetings, most recently the Oct. 19 Town Board meeting.
The process of forming a sidewalk district will take a while and will include a resolution by the board and a public hearing, board members said.
If the property owners on the other side of Lewiston Road want to have a sidewalk put in, they would have to pay for it, Underhill said.
